Mediation is a "WIN-WIN" alternative to Arbitration
Mediation can resolve disputes and promote amicable solutions which help promote better working relationships among members. Disputing REALTORS® who are principals or managing brokers meet with a neutral third party mediator, whose role is to help the parties resolve the conflict. The mediator does not make the decision. It is up to the parties with the help of the mediator, to reach their own solution. Mediation is informal, usually without witnesses, attorneys or evidence, etc. It is simply two brokers negotiating a mutually agreeable settlement. If mediation is not successful, arbitration is the next step.
The Greater Northwest Indiana Association of REALTORS® offers Mediation as a service free of charge to REALTOR® members. Mediation is always offered, as an option, prior to review of an arbitration request by the Grievance Committee. Upon receipt of a request for arbitration, the Professional Standards Administrator will inquire from all parties whether they desire to participate in mediation. If the parties agree to mediation, the matter will be referred to the Mediation Officer, who will arrange a mutually convenient time and location for mediation. If the mediation attempt is unsuccessful the request for arbitration will be referred to the Grievance Committee for review.
